Sex with inmate gets jailer convicted

Former correctional officer gets suspended sentence for having sex with inmate

A former correctional officer received a suspended sentence yesterday for having sex with an inmate.

Richard Walter Zacofsky, 39, was working at the Rappahannock Regional Jail when he was arrested earlier this year.

Zacofsky pleaded guilty yesterday in Stafford Circuit Court to a single felony count of carnal knowledge of an inmate.

As part of a plea agreement, he was sentenced to two years in prison, all of which was suspended.

Prosecutor Amy Casey dropped a forcible sodomy charge against Zacofsky.

Though the victim said the sex was against her will, Casey said an investigation convinced authorities that the sex was consensual. Consensual sex with an inmate by a correctional officer is still a felony.

According to Casey, Zacofsky, who was married at the time, became enamored with the inmate and began a relationship with her.

The two had sexual intercourse

once and several other sexually related encounters, she said.

At some point, jail officials heard about the relationship and confronted Zacofsky, Casey said. Zacofsky immediately admitted having relations with the woman and was fired.

The woman, who is married, is still incarcerated but is no longer at the Rappahannock Regional Jail.

...he's not a "law enforcement officer" as much as he may like to claim that. He's a correctional officer. Second of all, you can blame the judges who refuse to put anyone away for more than a weekend. Judge Willis is the only judge in this region who has enough spine to say "enough is enough" to the trash that comes before him. Seems to me he knows the difference between an honest mistake and somebody who needs to go bye-bye.

If this man had gone before Judge ( maximum sentence for minimal offenses ) Willis I think they would have found a spot in jail for this man.

But, he lost his job.In addition, he lost his reputation in the paper.Plus, he can't work in law enforcement anymore and he will have to put that conviction on all job apps. in the future.In addition, he has the hang time over his head not to mention what it probably did to his marriage.I think in this case he probably learned his lesson of no poky,poky with inmates.

no space in jail to do the time, so judges suspend and let em go.
