Walmart lawsuit goes to court

A judge today heard arguments in a lawsuit challenging Orange County’s approval of a Walmart Supercenter in the Wilderness battlefield area.

Circuit Judge Daniel Bouton did not immediately rule on the county’s request to dismiss the lawsuit filed by historic preservation groups and several county residents. He asked the clerk to produce a transcript of the hearing within 10 days.

In August, Orange supervisors granted a special-use permit to build a retail development anchored by a 138,000-square-foot Walmart northwest of the intersection of State Routes 3 and 20 about a quarter-mile from the entrance to Fredericksburg and Spotsylvania National Military Park.

Preservationists filed suit in September claiming supervisors failed to comply with the county’s comprehensive plan. The suit also claims the county’s zoning ordinance is invalid because it fails to comply with state laws requiring such ordinances to protect historic sites, and there were procedural defects in the approval process.

Today, Orange County attorney Sharon Pandak asked judge to dismiss the lawsuit because neither the organizations nor individuals named as plaintiffs have the legal standing to sue. She said government officials held several public hearings before granting the permit and that the county has control over its land-use decisions.

Robert Rosenbaum, attorney for the National Trust for Historic Preservation, noted that the individual plaintiffs live in the Wilderness battlefield area and that the trust was create by Congress to help protect the nation’s historic sites.

Move it 300 yards up the Road like they did at Ferry Farm and build it.... Stop the Whining.. It will bring Jobs and Tax Dollars. The County is NOT going to turn Wal-Mart away,,,, They would be foolish to do so......Sounds like the Rich want to Control every body like they always try to do,, Hey get some Actor to come and speak, That worked Well last year hahahha..... Shut Up !

I think some people fail to realize the benefits that Wal Mart would afford Orange County, One of the reasons there is such a budet crisis is because Orange County continues to believe in a small growth environment. the problem with this is, is that we all spend money outside the county as we don't have any other option. All of this tax revenue is being lost to other localities. The number of jobs it would provide would benefit those who have fallen on hard times. It's a shame it is taking so long!!!

If they can't go through the door they will go over it, if they can not go over it, they will pole vault over it. There will be a Walmart for the citizens of Orange County.
