Man cleared for now in murder case

Suspect had been charged in slaying of 26-year-old man as victim sat in a car.

A man accused of killing another young man in a Fredericksburg apartment complex parking lot last month is in the clear—at least for now.

Judge John R. Stevens ruled that the evidence presented at a preliminary hearing today was not enough to send a murder charge against 26-year-old Toronto D. Eura to a city grand jury.

Eura had been charged with killing 21-year-old Jamair Ellis of Unionville. Ellis was shot multiple times at close range while sitting in a car outside Forest Village apartments early Jan. 6.

Following the decision in General District Court, Commonwealth’s Attorney LaBravia Jenkins said the case against Eura is “not over.”

Jenkins, who did not elaborate, could still seek direct indictments from a grand jury.

But for now, Eura is no longer charged with murder. He is still in jail on other charges, Jenkins said, and has a trial on a marijuana distribution charge set for March 25.

City police got a call from Mary Washington Hospital about 1:25 a.m. Jan. 6 regarding Ellis.

A man who was with Ellis at the time somehow drove him to the hospital with Ellis still in the driver’s seat.

Ellis, who had been shot multiple times in the upper torso, was pronounced dead shortly after getting to the hospital.

The friend told police that he and Ellis were sitting in the car when a man approached and began firing shots into Ellis at close range. Police reported that the shooting was apparently the result of a “personal dispute.”

Eura was arrested the same day at his home in Prince William.

A prosecution witness today testified that she and Eura were in the area when Ellis was shot, but said she didn’t see where the shots came from.

Another person who’d been charged in connection with the case, Ebony Charde Boone, also had a charge against her dropped.

Boone, 22, had been charged with being an accessory to murder. In court records, she was accused of driving Eura from the scene that night.

It sounds like to me that "someone" didn't do their job!!!Such a ruling by a judge is very unusual...in this type of case.
