A man carrying a case of beer was struck by a vehicle Tuesday evening in the 5300 block of Jefferson Davis Highway in Spotsylvania, police said. Sheriff’s spokesman Lt. Eddie Peck said the accident occurred at 7:20 p.m. at Market Street and U.S. 1. A 41-year-old man was crossing from the north side when he was hit by a 2003 SAAB sedan. The victim was taken to Mary Washington Hospital and treated for non life-threatening injuries. Witnesses said he stepped into the southbound lanes without looking or stopping. The 23-year-old driver was charged with reckless driving. He told police he was slowing for a red light and did not have time to react. --Keith Epps
Before coming to a conclusion about whether the right steps were taken in the case please be better informed. The driver who hit the lady then sped off which is most likely the reason that he was charged at all. I think they are both at fault but more importantly this lady is hanging on the edge of life and death right now. At the end of the day the driver of the car has to be paying attention and the pedestrian does too. Who's fault is it if they were both careless?
Another charge available is the Careless or Mailicious Interference with the Flow of Traffic. This used in cases where pedestrians cause an accident and the county could still get its money. Without more info on why the driver was charged I dont know. I do know it was not a money making deal as either party could get a ticket. As a general rule the pedestrian has the right of way but not in all cases. It seems odd with the facts in the article the driver was charged. Fight it.
Reckless driving? I guess beer is important in Spotsy. I hope
the victim is OK and has learned to look both freakin ways the
next time she is carrying a case of beer across a busy street.
